Bone Tide Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Bone Tide LLC, a Georgia limited liability company doing business as Bone Tide Co. (“Bone Tide,” “we,” “us,” or “our”). They govern your access to and use of the Bone Tide mobile application, the BoneCast forecasting features, our website at bonetideco.com, and all related services, content, and features (together, the “Service”).

By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

Please read Section 18 carefully. It contains a binding individual arbitration agreement and a class-action waiver that affect how disputes between you and us are resolved.

1. Who we are and how to reach us

2. Eligibility and accounts

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. The Tide Kings contest is open only to users who are 18 or older (see Section 10).

To use most features you must create an account using Sign in with Apple or Google. You are responsible for maintaining the confidentiality of your login and for all activity under your account. You agree to provide accurate information and keep it current. Notify us at support@bonetideco.com if you believe your account has been compromised.

3. The Service

Depending on your plan and device, the Service may include: the Good Bite Score and BoneCast forecast (a model-based estimate combining tide, pressure, wind, and solunar timing); live NOAA tides; a home-screen widget; a catch logbook; AI Fish Scan (species suggestions from a photo via a third-party AI provider); an AI regulations assistant (general information only); a spot map with community catches, radar, and wind overlays; bones and rewards; the Gear Shop; the Bone Tide Club subscription; and community features (profiles, following, friends, feeds, rankings, angler discovery, and direct messages). We may add, change, or remove features at any time.

4. Forecasts, data, and safety

The Good Bite Score, BoneCast, tide data, solunar data, weather, and radar are provided for general informational purposes only and are estimates. They are generated from models and third-party data sources and may be inaccurate, incomplete, or unavailable. They are not a substitute for official marine forecasts, tide tables, or navigational and safety information.

You are solely responsible for your own safety. Always check official sources (such as NOAA, the National Weather Service, and the U.S. Coast Guard), use proper equipment, and exercise your own judgment before going on or near the water.

The AI Fish Scan and AI regulations assistant can be wrong. Species identifications are suggestions, not determinations. Regulation answers are general information, not legal advice, and may be out of date or incorrect. You are responsible for knowing and following all applicable fishing laws, licenses, seasons, size and bag limits, and protected-species rules.

5. Acceptable use

You agree to use the Service lawfully and to follow all applicable fishing and wildlife regulations. You agree not to: violate any law or the rights of others; upload content that is illegal, harassing, hateful, threatening, defamatory, obscene, or infringing; misrepresent catches or manipulate rewards, rankings, or the Tide Kings contest; farm, exploit, automate, or defraud the bones or rewards system; upload malware, scrape the Service, or interfere with its operation or security; reverse-engineer the Service except as permitted by law; or share others’ private spot locations without permission. We may remove content, adjust or remove bones, and suspend or terminate accounts for any violation.

6. User content and your license to us

You retain ownership of the photos, catch data, comments, and other content you submit (“User Content”). By submitting User Content, you grant Bone Tide a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, publish, display, and distribute that User Content in connection with operating, promoting, and improving the Service. This license ends when you delete your User Content or account, except for content others have shared or copied and except as needed for backups, legal compliance, or records of activity. You are responsible for your User Content and represent that you have the rights necessary to submit it.

7. Bone Tide Club subscription

Bone Tide Club is an optional auto-renewing subscription priced at $2.49 per month or $24.99 per year (US dollars), subject to change with notice. A free trial may be offered; if you do not cancel before it ends, you will be charged for the first period. Subscriptions are sold and billed through Apple’s App Store or Google Play and managed on our behalf by RevenueCat. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your Apple ID or Google account settings; deleting the app does not cancel a subscription. Refunds are handled by Apple or Google under their policies. The Club is currently offered in the United States only.

8. Bones and rewards

“Bones” are a promotional, in-app loyalty currency earned through activities such as logging catches, daily logins, and streak milestones. Bones have no cash value, are not money or property, and cannot be purchased, sold, transferred, or exchanged for cash. Bones may be redeemed in the app for rewards such as percentage-off discount codes (up to 30% off) and, for eligible Bone Tide Club members, a limited top-tier reward (a free item or store credit) available no more than once per year. The number of bones required for each reward, and any applicable caps, are shown in the app at the time of redemption and may change at any time. Discount and reward codes are single-use, non-transferable, valid for a single item and one per order, subject to an expiration date, and final. We may modify, suspend, expire, or revoke bones and rewards, and may adjust or remove bones obtained through error, abuse, or violation of these Terms. Bones are forfeited if your account is terminated.

9. Gear Shop and affiliate links

The Gear Shop and certain other areas contain affiliate links, including through the Amazon Associates program. If you buy through these links we may earn a commission at no extra cost to you. Products are sold by third parties, not by Bone Tide, and are subject to those sellers’ terms, pricing, and policies.

10. Tide Kings contest

Tide Kings is a recurring, skill-based fishing contest, not a lottery or game of chance. It is open to Bone Tide Club members who are 18 or older and legal U.S. residents. Each season runs approximately three months; catches you log during the season accrue bones that determine the rankings, and the first-place finisher wins a custom, one-of-a-kind Tide Kings shirt. We may verify catches and disqualify entries we believe are fraudulent, duplicated, manipulated, or in violation of these Terms or applicable law. Any prize winner is solely responsible for all applicable taxes. We may modify, suspend, or cancel a season or substitute a prize of comparable value at any time. Season-specific rules posted in the app control in the event of a conflict.

11. Community features

The Service includes public profiles, following and friends, feeds, rankings, angler discovery, and direct messages. Do not harass, threaten, impersonate, or spam other users. We provide tools to block and report users and content, and we may remove content or accounts that violate these Terms. Content and locations you mark public may be visible to other users.

12. Intellectual property

The Service, including its software, design, text, graphics, and the Bone Tide and Bone Tide Co. names and logos, is owned by Bone Tide LLC or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.

13. Third-party services

The Service relies on and links to third-party services and data, including NOAA, weather/radar/wind providers (such as Windy), Apple and Google (authentication and payments), RevenueCat (subscriptions), our AI provider, our hosting and image providers, and affiliate partners. Your use of third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services or content.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. On termination your license ends and your bones and unredeemed rewards are forfeited. Sections that by their nature should survive termination will survive.

15. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Bone Tide disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Service will be uninterrupted, timely, secure, accurate, or error-free.

16. Limitation of liability

To the fullest extent permitted by law, Bone Tide and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or property damage, arising out of or relating to the Service or these Terms, whether based in contract, tort, or any other theory. Bone Tide’s total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $50.

17. Indemnification

You agree to indemnify and hold harmless Bone Tide LLC and its members, managers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or the rights of a third party.

18. Governing law; arbitration; class-action waiver

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Please read this section carefully. You and Bone Tide agree that any dispute arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration, rather than in court, except that either party may bring a qualifying individual claim in small-claims court. You and Bone Tide agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. You may opt out of this arbitration agreement by emailing support@bonetideco.com within 30 days of first accepting these Terms. If the class-action waiver is found unenforceable, this entire Section 18 will be void.

19. Apple-specific terms

These Terms are between you and Bone Tide LLC only, not with Apple, and Apple is not responsible for the Service or its content. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update the “Last updated” date and, where appropriate, provide additional notice in the app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
